General Terms and Conditions (GTC) — Fahrzüg AI

1. Operator and Scope
These General Terms and Conditions ("Terms") govern the use of the Fahrzüg AI online platform ("Platform", "Fahrzüg") at fahrzueg.ch, operated by Mobil Digital GmbH, Heuerweg 7, 5605 Dottikon, Switzerland ("we", "Fahrzüg", "Operator"). By using the Platform you accept these Terms. Private sellers are additionally subject to the Private Seller Terms, and dealers are additionally subject to the Dealer Terms.
2. Definitions
"User" means any person using the Platform, whether or not registered. "Listing" means a vehicle entry published on the Platform. "Search Agent" means a saved, automated search. "Fahrzüg AI" means the automated, partly AI-assisted functions deployed on the Platform (text understanding, search, price estimation, reports).
3. Eligibility and Account
Certain functions require an account, created via an email magic link or Google login. You must provide truthful information at registration and in your profile, and keep it current. You are responsible for the security of your account and credentials and must notify us promptly if you suspect unauthorized access.
4. Role of the Platform
Fahrzüg AI is an intermediary platform. We are not a party to purchase agreements concluded between buyers and sellers and do not become the owner of any advertised vehicle. We provide infrastructure, search functionality, and supporting tools (including Search Agents, automated matching, and PDF reports), but we do not make purchasing decisions ourselves and give no warranty regarding the advertised vehicles.
5. Private Users and Dealers
The Platform distinguishes between private users and verified dealers. Dealer verification is carried out exclusively through manual review by Fahrzüg; no automatic lookup of official registries takes place. While verification is pending or has been rejected, dealer-specific functions (e.g. import sources) remain unavailable.
6. Creating Listings
Anyone creating a listing must either own the vehicle or be expressly authorized to publish it. Information on make, model, year, mileage, condition, and price must be truthful. The person creating the listing must hold the necessary rights to any uploaded photos and content; uploading third-party or copyrighted images without authorization is prohibited.
7. Responsibility for Content
Users are solely responsible for the accuracy and lawfulness of the content they submit. Fahrzüg reviews listings through an automated and partly manual moderation process but gives no warranty as to their content. In particular, the following are prohibited: misleading pricing, stolen or unlawfully used photographs, duplicate/spam listings, unlawful or prohibited items, harassment of other users, manipulation of search results or ratings, and the unauthorized publication of third parties' personal data.
8. Import and External Sources
Where a listing is submitted via an import source (CSV, JSON file, or a user's own source URL), Section 6 applies unchanged; the Import Terms apply in addition. Every imported item is manually reviewed before publication.
9. Contact Between Buyer and Seller
Contact requests are only sent after the requesting person's explicit confirmation. The Contact Terms apply in addition. Any purchase agreement concluded between users is exclusively a matter between the contracting parties; Fahrzüg is not involved and gives no brokerage or performance guarantee.
10. Fees and Subscriptions
Certain functions (e.g. higher limits, additional Search Agents, PDF reports) may be offered under paid plans. The Subscription Terms apply in addition. No real payment processing is currently active; stated prices are provisional.
11. Usage Limits, Downgrades, and Fair Use
Each plan defines limits (e.g. number of active listings, Search Agents, PDF reports per month). Switching to a smaller plan never deletes data; listings or Search Agents above the new limit are paused, not deleted, and the affected person may choose which items stay active. Abusive use that places excessive strain on the technical infrastructure ("fair use") may result in a temporary restriction.
12. Suspension and Termination
In the event of violations of these Terms, the Platform Rules, or applicable law, we may remove content, temporarily suspend accounts, or terminate the usage relationship. The Moderation Policy, including the reporting and appeal procedure described there, applies in addition.
13. Availability and Maintenance
We strive to operate the Platform reliably but cannot guarantee uninterrupted availability. Maintenance work may cause temporary restrictions.
14. AI Features, Search Agents, and Reports
The AI/Search Agent/PDF Terms apply in addition. Automated functions may contain errors and do not replace the user's own review.
15. Warranty
To the extent permitted by law, use of the Platform is provided without any assurance of a particular level of availability, error-freeness, or fitness for a particular purpose. Mandatory provisions of Swiss law, in particular consumer-protection provisions, remain unaffected.
16. Liability
To the extent permitted by law, we are not liable for indirect damages, lost profits, or consequential damages arising from use of the Platform or from agreements concluded between users. Liability for unlawful intent and gross negligence, and any mandatory statutory liability, remains reserved.
17. Indemnification
To the extent legally permissible and appropriate, you indemnify us against third-party claims arising from your breach of these Terms or from unlawful content you have submitted.
18. Data Protection
Our Privacy Policy, which describes the processing of personal data in detail, applies in addition.
19. Amendments and Versioning
We may amend these Terms. Material changes are published as a new, versioned edition; where renewed consent is required, we will obtain it again. Purely editorial corrections do not require renewed consent.
20. Severability
Should any provision of these Terms be invalid, the validity of the remaining provisions is unaffected.
21. Governing Law and Jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory jurisdiction provisions at the place of domicile remain reserved. Otherwise, to the extent legally permissible, the Operator's registered seat is the place of jurisdiction.
